These Terms and conditions (hereinafter the «Terms») govern and regulate accesing and using of this website SUMMUS.GAMES (hereinafter the «Website») and iGaming content available on the Website (hereinafter the «iGaming content»).

By visiting or using the Website and iGaming content, YOU (hereinafter the «Customer», «you», «your») hereby signify that you have read, understood and agree to be bound by the Terms. 

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS THE SITE OR USE THE SERVICES.

ABOUT US

The Website is owned and operated by SUMMUS LAB LLC, a company registered and established under the laws of Ukraine, with the registered address of 20 Dashkovicha str., Cherkasy, Ukraine (hereinafter «Summus», «Company», «we», «us» or «our»). 

The iGaming content is lottery type games developed by Company or it’s licensors.

CONDITIONS OF USE

The Customer is permitted to access and use the Website and the iGaming content solely for lawful purposes and in compliance with these Terms. By using the Website and the iGaming content, the Customer agree that he/she/it will not:

• use the Website or the iGaming content in any way that breaches applicable laws or regulations, whether local, national, or international; 

• distribute or transmit any unsolicited or unauthorized advertising or promotional materials, including but not limited to spam or similar forms of solicitation; 

• impersonate or attempt to impersonate the Company, its employees, other users, or any third party, including by using misleading or unauthorized email addresses or identities; 

• engage in any activity that could cause harm to the Company, its users, or expose them to legal liability; 

• upload, share, or distribute any content that may be considered offensive, defamatory, abusive, threatening, discriminatory, obscene, or otherwise inappropriate; 

• take any actions that could disrupt, damage, overload, or negatively affect the performance of the Website or the iGaming content, or interfere with other users’ ability to access or use it, including real-time features; 

• use any tools, software, or automated processes that may interfere with the proper functioning of the Website or the iGaming content, including introducing malicious code such as viruses, worms, or similar harmful elements; 

• attempt to gain unauthorized access to any part of the Website or the iGaming content, its servers, databases, or related systems, or otherwise disrupt their operation; 

• engage in any other activity that may compromise or interfere with the normal operation and security of the Website and the iGaming content.

B2B DISCLAIMER

Summus is exclusively a B2B (business-to-business) iGaming content supplier. The Company licenses iGaming content that is integrated into platforms operated by licensed gambling and lottery operators.

Summus is not a B2C online casino, gambling or lottery operator. The Company does not operate gambling platforms, manage player accounts, process financial transactions, or provide gambling services directly to end users.

Gambling and lottery operators bear full and exclusive responsibility for the operation of their business activities. In particular, the operator agrees and acknowledges the following obligations:

• Licensing: The operator is required, at its own cost, to obtain and maintain all necessary licenses, permits, and regulatory approvals in each jurisdiction where its services are offered. The Company reserves the right to request evidence of such authorizations at any time. 

• Compliance with Local Regulations: The operator is solely responsible for ensuring compliance with all applicable local laws, regulatory requirements, and licensing conditions. Any requests related to jurisdiction-specific functionality must be submitted to the Company as separate development requests, accompanied by detailed technical specifications. The Company shall not be responsible for adapting the iGaming content to meet specific regulatory requirements of any market. 

• Responsible Gambling: The operator must independently implement and maintain appropriate responsible gambling measures and player protection policies in accordance with applicable laws and industry standards. 

• Player Verification (KYC): The operator is responsible for performing all required identity verification procedures, including KYC, age verification, and fraud prevention checks for its end users. 

• Anti-Money Laundering (AML/CTF): The operator must comply with all applicable anti-money laundering and counter-terrorist financing regulations in the jurisdictions in which it operates. 

• Player Management and Support: All interactions with end users, including the handling of player funds, customer support services, and dispute resolution, remain the sole responsibility of the operator. 

• Bonuses and Promotional Activities: The operator assumes full responsibility for any bonus schemes or promotional campaigns offered to players. This includes responsibility for managing risks, handling fraudulent activity, addressing player complaints, and resolving disputes.

COMMITMENT TO RESPONSIBLE GAMING

While Summus does not provide gambling services directly to players, it acknowledges its responsibility to design iGaming content that align with responsible gaming standards and contribute to safe gaming environments, seeks to ensure that the iGaming content can be integrated into regulated gaming environments operated by licensed partners.

The Company supports initiatives and practices that encourage safe participation in gaming activities and help reduce the risks associated with excessive gambling behavior.

The Company encourages its partners to implement appropriate player protection measures and to promote responsible gaming policies on their platforms.

Individuals who believe that their gaming behavior may be becoming problematic are encouraged to seek professional guidance and support. Examples of independent support organizations operating independently and providing resources, counseling information, and support services for individuals seeking help regarding gambling-related issues, include:

As part of its commitment to responsible business practices, the Company continues to monitor developments in the regulatory landscape and supports efforts aimed at strengthening player protection and responsible gaming frameworks within the global iGaming sector.

INTELLECTUAL PROPERTY RIGHTS

The Website, its content, features, and functionality (including but not limited to all information, software, games, text, graphics, logos, and the design and arrangement thereof), and the iGaming content are the exclusive property of Summus and its licensors. It is protected by international copyright, trademark, and other intellectual property laws.

The Company can grant for operators a limited, non-exclusive, non-transferable, revocable license to use the iGaming content for your internal business operations, subject to the specific service agreement. The Customer agrees not to copy, modify, create derivative works of, publicly display, or republish any of our copyrighted material.

All the cases of using our trademarks and/or business names, should be made only after our written approval. Otherwise any usage of Companies intellectual property rights, logos and brand name is forbidden.

DISCLAIMER OF WARRANTIES

The Website and the iGaming content are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied.

The Company does not warrant that the Website or the iGaming content will be uninterrupted, error-free, or secure. The Company does not guarantee that the Website or the iGaming content will meet Customer’s specific business requirements or that all technical issues can be resolved.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL DOMINATOR PLAY, OUR AFFILIATES OR OUR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, OR ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF THE COMPANY OR OUR AUTHORIZED REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE. THE COMPANY WILL NOT BE LIABLE FOR ANY DAMAGES OR INJURY CAUSED BY, INCLUDING BUT NOT LIMITED TO, ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, AND DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, OR LINE FAILURE.

EXTERNAL RESOURCES

The Website may contain links to the external resources (websites, services and other resources) which are owned and operated by third parties. Customer follows these links/hyperlinks to the external resources at its own risk. These resources are outside Summus’s control and the Company bears no liability for the content of any external resources and bear no responsibility for anything that can happen as a result of your visit to external resources.

PRIVACY POLICY

The Company processes Customer’s personal data in accordance with the Website`s Privacy Policy. Please, read our Privacy Policy prior to use the Website and the provision of any personal data to us.

INDEMNIFICATION

The Customer agrees to indemnify, defend, and hold harmless the Company, along with its affiliates, subsidiaries, directors, officers, employees, and representatives, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) that arise out of or are connected with:

• any breach of the Terms by you, or by any person accessing the Website through your network, account, or devices; 

• your use of, inability to use, or misuse of the Website or the iGaming content; 

• any violation of applicable laws, regulations, or third-party rights; 

• any obligations or responsibilities assigned to you under the Terms or applicable law. 

The Customer further agrees to provide reasonable assistance and cooperation in the defense or settlement of any such claims, as may be requested by the Company.

ACCESS. REVISION OF THE TERMS

Access to the Website or any content therein is not guaranteed to be continuous or constant. 

The Company reserves the right to suspend, withdraw, or modify the Website (or any part thereof) without notice. The Company will not be held liable for the Website being unavailable at any time or for any duration. Furthermore, The Company may restrict access to certain areas or features of the Website to users based on geographic location or other criteria at our discretion.

GOVERNING LAW & JURISDICTION

The Terms shall be governed by and construed in accordance with the laws of Ukraine.

Any disputes arising out of or in connection with the Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.
